Acknowledgment vs. Jurat: The Two Core Notarial Acts Explained

The most frequent error leading to rejected court filings and recording office delays is attaching the incorrect notarial certificate to a legal instrument. A commissioned Notary Public cannot legally choose the certificate for a signer—doing so constitutes the Unauthorized Practice of Law (UPL). The signer, the issuing agency, or legal counsel must specify whether the document requires an Acknowledgment or a Jurat.

1. The Acknowledgment: Voluntary Execution

An Acknowledgment is used primarily for documents that convey property, establish fiduciary authority, or transfer valuable assets—such as Warranty Deeds, Deeds of Trust, Powers of Attorney, and Living Trusts. In an Acknowledgment, the signer declares to the Notary Public that they understand the contents of the document, that they signed it of their own free will, and that their signature is genuine.

Key Operational Rule for Acknowledgments: The document does not necessarily have to be signed in the physical presence of the Notary Public. A signer may sign the document yesterday at home and bring it before the notary today—provided the signer personally appears, proves their identity with valid photo ID, and verbally acknowledges that the signature is indeed theirs.

2. The Jurat: Sworn Oaths Under Penalty of Perjury

A Jurat (historically abbreviated from the Latin juratum est, meaning "it has been sworn") is used when the contents of the document must be sworn to be true under penalty of perjury. Common instruments requiring a jurat include Affidavits, Depositions, Court Pleadings, Interrogatories, and Applications for Government Benefits.

The Golden Rule for Jurats: The document MUST BE SIGNED IN THE DIRECT PRESENCE OF THE NOTARY PUBLIC. If you pre-sign an affidavit or sworn statement before arriving at the notary desk, the notary is legally obligated to have you re-sign the document in their presence after administering an oral oath or affirmation.

3. Administering the Spoken Oath or Affirmation

A jurat is legally void if the Notary Public fails to administer a verbal oath or affirmation. The notary must ask the signer: "Do you solemnly swear that the statements contained in this document are true to the best of your knowledge and belief, so help you God?" or, for non-religious signers: "Do you solemnly affirm under penalty of perjury that the statements contained in this document are true?"

Self-Inking Stamp vs. Seal Embosser Verdict (New Zealand):
• Self-Inking Stamp: Mandatory in almost all U.S. states because photographically reproducible black ink is required by county recording clerks.
• Seal Embosser: Highly recommended or mandatory for international instruments, maritime protests, and Hague Convention apostille filings where raised crimping proves original authenticity.
• Best Practice: Commissioned notaries handling overseas deeds often pair both on a single certificate.
